Under US law, cryptocurrencies are considered
commodities. As a result of Dodd-Frank, it is now
possible to be charged with insider trading with
commodities, but the number of cases in which CFTC has
charged someone with Bitcoin Market Insider on
commodities is very low, and nowhere near the
situation with equities.
Basically, the charges that CFTC has brought against
commodities traders for insider trading have been
cases in which a trader has stolen information from
his employer.
This makes sense, because the purpose of insider
trading law in equities is to prevent banks from
screwing each other over. If JPMorgan knows that
Goldman-Sachs is using insider information to trade
stocks, then no one will trade and no one will make
money.
With commodities, it is highly unlikely that one bank
will have insider information that someone else does
not.
Also this applies only to cryptocurrencies,
Cryptosecurities are under SEC rules.
